Welcome to Escape Airbnb Kenya. By booking accommodation with us, you agree to comply with these Terms and Conditions. Please read them carefully before confirming your reservation.
1. Booking and Guest Information
1.1 Guest Registration
All guests must be registered at the time of booking. The primary booker is responsible for ensuring all guest information is accurate and complete.
1.2 Occupancy Limits
- Each accommodation has a maximum occupancy limit clearly stated in the property description
- The number of guests cannot exceed the booked capacity without prior authorization
- Children of all ages count toward the total occupancy limit
1.3 Unauthorized Additional Guests
Penalty Structure:
- 1-2 bedroom units: KES 1,000 minimum fine per unauthorized guest
- 3+ bedroom units: KES 2,500 minimum fine per unauthorized guest
- Additional accommodation charges may apply if space permits
- Management reserves the right to refuse entry to unauthorized guests
2. Property Use and Conduct
2.1 Designated Property Types
Certain accommodations are designated as:
- Quiet retreats (no parties or events)
- Family-friendly units (restricted noise levels)
- Business accommodation (professional use only)
Property restrictions are clearly indicated in each listing description.
2.2 Prohibited Activities
The following activities are strictly prohibited:
- Smoking in non-smoking designated properties
- Parties or events in restricted properties
- Excessive noise that disturbs neighbors
- Illegal activities of any nature
- Use of facilities beyond their intended purpose
2.3 Immediate Eviction Policy
Violation of property rules may result in:
- Immediate eviction without notice
- No refund of accommodation fees
- Forfeiture of security deposits
- Additional charges for damages or cleaning
3. Damage and Property Care
3.1 Guest Responsibility
Guests are fully responsible for:
- Maintaining the property in good condition
- Reporting any existing damages upon arrival
- Using all amenities and equipment appropriately
- Ensuring all guests follow property guidelines
3.2 Damage Assessment and Charges
Pre-Checkout Inspection:
- All damages must be assessed and settled before checkout
- Guests will be charged for repairs, replacements, or professional cleaning
- Payment is required immediately upon damage assessment
Specific Damage Categories:
- Fabric staining: Cleaning or replacement costs
- Wall damage: Repair and repainting charges
- Furniture damage: Repair or replacement at current market value
- Equipment malfunction: Repair or replacement costs due to misuse
3.3 Security Deposits
- Security deposits may be required for certain properties
- Deposits are refunded within 7 days if no damages occur
- Damage costs exceeding the deposit require additional payment
4. Legal Compliance
4.1 Guest Legal Responsibility
- Guests are fully liable for any illegal activities conducted on the property
- Management will cooperate fully with law enforcement investigations
- Guests must comply with all local, county, and national laws of Kenya
4.2 Consequences of Illegal Activities
- Immediate eviction without refund
- Full cooperation with law enforcement
- Potential legal action for property damages
- Permanent ban from all Escape Airbnb Kenya properties
5. Check-in and Check-out Procedures
5.1 Standard Times
- Check-in: 3:00 PM
- Check-out: 11:00 AM
- Early check-in or late check-out subject to availability and additional charges
5.2 Checkout Requirements
- Property must be left in reasonable condition
- All damages must be reported and settled
- Keys and access cards must be returned
- Final walkthrough with management may be required
6. Payment and Fees
6.1 Payment Schedule
- Full payment or deposit required at booking confirmation
- Outstanding balances due before or upon arrival
- All fines and damage charges payable immediately
6.2 Accepted Payment Methods
- M-Pesa
- Bank transfer
- Credit/debit cards
- Cash (Kenyan Shillings or US Dollars)
6.3 Additional Charges
- Cleaning fees for excessive mess
- Utility overuse charges
- Late checkout fees
- Key replacement fees
- Any applicable government taxes
7. Cancellation and Refund Policy
7.1 Standard Cancellations
Cancellation terms vary by property and season. Please refer to your booking confirmation for specific policies.
7.2 No Refund Situations
- Eviction due to rule violations
- Illegal activities on the property
- Failure to comply with terms and conditions
- Voluntary early departure
8. Liability and Insurance
8.1 Guest Liability
Guests are responsible for their personal belongings and any injuries occurring during their stay due to their own negligence.
8.2 Property Owner Liability
We maintain appropriate insurance but guests are advised to have their own travel insurance covering personal belongings and liability.
9. Communication and Disputes
9.1 Management Contact
- 24/7 emergency contact available
- Non-emergency issues addressed during business hours
- All communication should be directed through official channels
9.2 Dispute Resolution
- Initial disputes handled directly with property management
- Escalated issues may require mediation
- Legal disputes subject to Kenyan jurisdiction
10. Privacy and Data Protection
We respect guest privacy and handle personal information in accordance with Kenyan data protection regulations and our Privacy Policy.
11. Modifications to Terms
These terms may be updated periodically. Guests will be notified of significant changes, and continued use of our services constitutes acceptance of modified terms.
